Event Data Recorders In Late Model Cars

Here's an article from the Washington Examiner discussing the use of event data recorders, or "little black boxes", that apparently are common in late model vehicles, to figure out how and why accidents happen.  Some prosecutions have resulted.

Is it spoliation of evidence if the little black box isn't preserved in a bad accident?
